We / Us etc means Verdant Dwellings and any subsidiaries, affiliates, employees, officers, agents or assigns.

Accuracy of content

We have taken proper care and precautions to ensure that the information we provide on this Website is accurate. However, we cannot guarantee, nor do we accept any legal liability arising from or connected to, the accuracy, reliability, currency or completeness of anything contained on this Website or on any linked site.

The information contained on this Website should not take the place of professional advice.

Use

The Website is made available for your use on your acceptance and compliance with these terms and conditions. By using this Website, you are agreeing to these terms and conditions.

You agree that you will use this website in accordance with all applicable local, state, national and international laws, rules and regulations.

You agree that you will not use, nor will you allow or authorise any third party to use, the Website for any purpose that is unlawful, defamatory, harassing, abusive, fraudulent or obscene way or in any other inappropriate way or in a way which conflicts with the Website or the Services.

If you contribute to our forum (if any) or make any public comments on this Website which are, in our opinion, unlawful, defamatory, harassing, abusive, fraudulent or obscene or in any other way inappropriate or which conflict with the Website or the Services offered, then we may at our discretion, refuse to publish such comments and/or remove them from the Website.

We reserve the right to refuse or terminate service to anyone at any time without notice or reason.

SHIPPING RESTRICTIONS

Postage on checkout applies to all states and territories in Australia. It is the customer’s responsibility to select the correct shipping option as costs to each location vary and Verdant Dwellings will contact a customer if shipping to their selected address has not been covered by the shipping selection made on checkout.

Verdant Dwellings uses Big Post Shipping, Shippit and Australia Post and as such is bound by their prices. Shipping is calculated by Carriers based on the size and weight of the parcel, as well as the delivery location. Big Post, Shippit and Australia Post do not offer a fragile option on parcels and as such Verdant Dwellings hold no responsibility for damaged items on delivery. Utmost care is taken by Verdant Dwellings when packaging items. Verdant Dwellings ships to the address supplied by the customer and holds no responsibility for shipping delays or complications when the shipping address on an order has been entered by the customer incorrectly or incompletely. All orders are marked ‘leave safe’ unless ‘signature required’ is specifically requested by the customer.

Orders are shipped Monday with a cut off of 7am Monday. Any order received after this time will be shipped the following week, not the same day. Once an order is made shipping cannot be brought forward and, due to limited storage, orders cannot be held for shipping at a future date.

Please Note: any completed purchase orders where the incorrect shipment has been selected, or the shipping amount is incomplete, will not be shipped until the correct amount has been paid and received by Verdant Dwellings.

TASMANIA, WESTERN AUSTRALIA & NORTHERN TERRITORY SHIPPING incurs a higher cost than the other states and territories due to location. Tasmanian, Western Australian and Northern Territory Biosecurity also require plants to be treated and a Plant Health Certificate to be created for any plants shipped from Verdant Dwellings to Tasmania, Western Australia or Northern Territory. The cost of this Certificate is PER ORDER on top of the shipping cost. When TAS, WA or NT shipping is selected on check out, this quarantine treatment and paperwork fee is combined with the shipping cost. PLEASE NOTE: Biosecurity Departments in TAS, WA and the NT may choose to do an additional and random spot inspection of plants themselves in addition to the Plant Health Certificate attached by Verdant Dwellings. If this occurs, the Plant Health Certificate will not be on your parcel and your States Biosecurity may choose to issue an inspection fee for their time. This fee is to the consignee (customer) for choosing to import Plant matter into the State. Unfortunately, Verdant Dwellings has no control over these random spot inspections and fees as they are State Governments Protocol and different in all States. Please be aware of this if purchasing to Import into these States.

LOSS OR DAMAGE

Verdant Dwellings hold no accountability for loss of item or damage during transit and by using the website the customer agrees to these terms and conditions. Once items have left Verdant Dwellings and are with Australia Post or Couriers, the customer agrees responsibility lies with the shipping companies and not Verdant Dwellings itself. Due to privacy laws, limited information about an item can be given to Verdant Dwellings once an order has shipped. Once plants have left Verdant Dwellings care, responsibility for issues or demise of plants is taken by the customer, not by Verdant Dwellings.

PLANT RESTRICTIONS

Some plants are not able to be shipped to some States based on each States Biosecurity Regulations. Verdant Dwellings, when known, mark this on plant listings, however, it is up to the customer to know what can and cannot be sent to their specific state. Verdant Dwellings will not be held responsible if banned plant materials are confiscated due to Quarantine Laws in each state.

EXCHANGE AND REFUND

Plants and items that are purchased online and picked up or purchased directly from Verdant Dwellings in person, including direct sales, are assumed to meet the approval of the customer once the customer has chosen and taken the plant and or item from the premises. Verdant Dwellings, therefore, offers no exchange or refund on items if the customer has a change of mind or decides later the plant or item is not of an acceptable standard.

Order Contents cannot be altered once put through the Carrier systems. Any order changes must therefore be completed by 7am Monday (Victorian Time). No changes will be available after this time.

It is at the discretion of Verdant Dwellings whether orders placed online will be refunded in full before shipping due to the reasoning behind the requested refund. In most cases, a processing fee will be retained if a refund is issued. Once an order has been put through the carrier’s system, the shipping fee will not be refunded as it has been paid to the carrier. After 7am Monday the previous week’s orders have been put into the carrier system for shipping and a fee will be retained by Verdant Dwellings if a refund is requested.

Verdant Dwellings does not exchange or refund orders once they have been shipped and does not accept returns once orders have been received and opened. Once in customer care, Verdant Dwellings holds no responsibility for the loss of plants or failure to thrive due to customer incorrect management.

WORKSHOPS

Workshops are held on-site with booking through the website. Any booking cancelled within 24 hours of the session start time will incur a 50% booking cost fee. Sessions cancelled earlier than 24 hours before a booking will be refunded in full. No-shows will not receive a refund on ticket cost. Refunds of ticket prices will not be given after the session is completed.

Verdant Dwellings may need to cancel or move the dates of sessions. If this occurs and attendance is no longer achievable, the ticket price will be refunded in full.

DISCOUNTS

A discount code may be issued for a variety of reasons such as swapping an ordered plant for one of lesser value before shipping, more shipping than required paid etc. These discount codes are personalised and will be emailed along with details directly to the individual customer by Verdant Dwellings. These personal discount codes are valid for one year from the issue date and if not used in that time, will expire. They will not be re-issued if not used after 12 months.

eVOUCHERS

eVouchers are available in specified amounts and must be purchased separately for code generation. They are redeemable in-store and online for shipping or pick-up orders. They do not have an expiry date. eVouchers are not redeemable for cash or services. eVouchers are non-refundable. The minimum eVoucher amount is $25. For multiples over $150 more than one eVoucher can be purchased.

Passwords and logins

You are responsible for maintaining the confidentiality of your passwords and login details and for all activities carried out under your password and login.

Indemnification for loss or damage

You agree to indemnify Us and hold Us harmless from and against any and all liabilities or expenses arising from or in any way related to your use of this Website or the Services or information offered on this Website, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and solicitors fees of every kind and nature incurred by you or any third parties through you.

Intellectual property and copyrights

We hold the copyright to the content of this Website, including all uploaded files, layout design, data, graphics, articles, file content, codes, news, tutorials, videos, reviews, forum posts and databases contained on the Website or in connection with the Services. You must not use or replicate our copyright material other than as permitted by law. Specifically, you must not use or replicate our copyright material for commercial purposes unless expressly agreed to by Us, in which case we may require you to sign a Licence Agreement.
